Can I refuse to allow the other parent to see our child if child support is not being paid?

 

Can I stop paying child support until the other parent lets me see our child?

 

No.

 

Kansas law provides that a parent may not deny parenting time simply because the other parent has not made timely child support payments. Similarly, A parent cannot refuse to pay child support because parenting time has been limited or denied. The obligations to pay child support and allow parenting time are independent and are both rights of the child. Denial of parenting time should not be used as a "lever" to enforce a financial obligation which exists between the parents.

 

Every child and every parent has a right to see the other. Every child needs to have a bond with both parents.

Every child deserves financial support from both parents.
